No I believe the fluid runs down from the convertor. Just like your engine the oil level will be higher when cold cause the oil has run down from the rockers etc etc

Yea when cold and not running the level will be higher cause it drains down when not running. Checking whilst running is fine but probably not as good as when not running straight after turning off.
